The Act and the Agent (cont.)

Death is the mode the image requires. Part 2 of 2.

Part 1 argued that S still requires P, and that T does not discharge the deed.[1] This part asks what P must be when S is the killing of three image-bearers by the hands that fed them. I shall argue that the fitting mode is death. Confinement may keep a body off the street. It does not, by itself, say what S was.

The sword the magistrate bears is not first a clinic with a lock. Romans 13 names him a servant who does not bear the sword in vain: a terror to the evildoer, an avenger who carries out wrath. Genesis 9:6 names the ground: whoever sheds human blood, by humans his blood will be shed, for God made humans in his image. The image of God is in the slain. Cora, Dawson, and Callan bore it. S is the shedding of that blood. The text does not first ask whether the shedder can complete a syllogism. It names a reciprocity between blood and blood because the victim is not an animal and not a problem set.

Numbers 35 will not take a ransom for the life of a murderer who deserves to die. The land is polluted by blood, and that blood has no expiation except by the blood of the one who shed it. That is not a mood. It is a claim about what kind of deed S is. If S is murder in that sense, a commitment ward offered as the judgment is still T. A life sentence can be P in form and still not be E.The question is not whether a lock is severe. The question is whether the sentence means the image.

Call that sentence E: death pronounced in public for this kind of bloodshed. The opposing view, even among those who grant Part 1, is that D or C commutes E into confinement under sentence. Call that commutation L. L says: guilty enough for P, not guilty enough for E. I shall argue that L does not follow from D, and that for S of this description P is not complete short of E.

Case I. Diagnosis does not commute the kind

Suppose D is real and S is still the slaying of three children in the house. L keeps P and retires E on the strength of D. That pair does not hold unless S has become U. Part 1 denied that D is already U. If S is not U, the texts that refuse a ransom are still on the table. D may be entered in the record. It does not rewrite the kind.

Case II. Fewer stripes are not a tariff for this blood

Luke 12 allowed fewer stripes for the servant who did not know. Fewer stripes are still stripes, and they are still calibrated to a servant who lives. The text is not a tariff for bloodguilt of this magnitude. Three image-bearers are not a household rule broken in ignorance. If measure is the point, the measure in Genesis 9 is already named: blood for blood, because of the image. L asks for a second measure that the slaying text does not give.

Case III. A lock is two acts

A locked ward can be two different acts. If the lock is imposed because she is ill and might be ill again, the act is T plus incapacitation. If the lock is imposed because S was a crime and the sentence is her remaining years, the act is P in the mode of L. Atkins’ commitment statute is built as the first. Relabeling it the second does not make it the second. P has to say guilt. A finding of no criminal responsibility cannot carry L as P. Even when guilt is found and L is truly a sentence, L still does not reach E.

Case IV. Vengeance is not the name of the text

People will say E is vengeance. Part 1 already granted that vengeance and justice are not synonyms. Genesis 9 is not a father’s heat. It is a public rule given after the flood, to a world that will keep shedding blood, assigning the reciprocity to human hands under God. The magistrate who pronounces E is not the children’s avenger in the private sense. He is the servant who will not let the image be treated as a case. Refusing E because the word feels hot is not humility. It is a refusal to let the text name the kind.

Case V. Restoration is not the criterion

People will say E cannot restore the children, and therefore L is enough. Nothing restores the children. That fact cuts both ways. If restoration were the criterion, both E and L would fail, and T would fail with them. The criterion in the slaying texts is not restoration. It is whether the public order will tell the truth about what was shed. E is that telling, in the mode the texts name. L, offered as enough, is a telling that the image was worth a locked door.

Conclusion

Part 1 denied Atkins’ claim:

(A) If D destroyed capacity, justice is T and ¬P.

The load-bearing claim of this part is:

(B) If S is this slaying and S is not U, then P is not complete short of E.

(B) does not reopen the denial of (A). S remains S after D is entered. P remains required. T is not P. L may be P in form if guilt is actually found, and still not be the mode the image requires. From D it does not follow that E is commuted. From Luke 12 it does not follow that this blood takes the servant’s tariff. From a lock it does not follow that the sentence has named the kind. From discomfort about vengeance, it does not follow that Genesis 9 is a private heat. From the fact that nothing restores the children it does not follow that L is enough.

So (B) stands if Part 1 stands. The children are not the occasion for a theory of mind. They are the slain. The image of God is in the slain. The magistrate who will not name the deed in the mode the law names has not become merciful. He has become a clerk of outcomes.

Notes

  1. Letter-symbols in this note are local to this note only; they are not the series alphabet. E, L, and Part 1 letters remain local to this pair of notes.
  2. Continues “The Act and the Agent,” Part 1 (9 September 2026). S, D, C, P, T, and U are used as there. E is death pronounced in public for this kind of bloodshed. L is confinement under sentence offered as a commutation of E.

3. Genesis 9:6: blood for blood because of the image. The verse assigns the reciprocity to human agency under God.

4. Numbers 35:31–33: no ransom for the murderer who deserves to die; blood pollutes the land.

5. Romans 13:4: the magistrate does not bear the sword in vain.

6. Luke 12:47–48 bears on measure among servants. It does not rewrite Genesis 9 for S.

7. This essay does not describe a method. It names a mode of public judgment.

8. Nothing here denies D as a medical fact, or denies that care should have reached her before S. The denial is that D or C already selects L or T once S is this slaying and is not U.
